Destination - Civil Marriages


Civil marriages are solemnised under the special marriage act, 1954. Normally those who opt for civil marriages are inter religious, inter cultural or inter communal couples that do not choose to go through a religious ceremony. This seems to be the best way to set aside differences of religion and culture. Besides, civil marriages are neither expensive nor loud and are the ideal type of marriage in today's day and age when couples are, too busy to spare months on pre marriage and marriage planning.\

The special marriage act permits couples to be married, if they fulfill the conditions prescribed for marriage these are :
  • The bride should be at least 18 years old the groom 21.

  • None of they have a living spouse at the time of marriage

  • They are mentally and physically sound for marriage and procreation

  • Neither of them suffers from frequent bouts of epilepsy or insanity.
They do not fall within such a relationship with each other as are considered prohibited relationships for marriage under the act.

The act prescribes that notice of one month be given before the actual marriage date. The notice is to be given on a prescribed form and on the payment of a nominal fee. Proof of residence and proof of age are necessary when submitting the form for notice.

At the end of one month, in case there have been no objections to the marriage from any quarter, the couple is free to get married either in the registrars office or at a place not very far away from the office, in the presence of the marriage registrar. Nominal fees will have to be paid in both the cases.

Importantly, 3 witnesses are required to be produced, who will sign on the declaration in the presence of the Marriage Officer. The Marriage officer will countersign the declaration. This shall not be complete and binding on the parties unless each party says to the other in the presence of the Marriage officer and the three witnesses and in a language understood by the parties 'I take thee (name of the husband) to be my lawful wife.'

The marriage is then solemnised and the couple is man and wife.

The couple will then have to apply for a marriage certificate, which they will get within a few days.
